Who Can Buy Agricultural Land in Tamil Nadu? Ceiling Limits, NRI Rules and Checks

By Jumbo Realty · 3 November 2026 · 7 min read
In short: in Tamil Nadu you do not need to be a farmer to buy agricultural land. Any Indian citizen resident in India can buy it, but the total a person or family can hold is capped by the land ceiling law. NRIs and OCI cardholders cannot buy agricultural land, plantation property or farmhouses anywhere in India; they can only inherit them.

Do you need to be a farmer?

No. Some states only let agriculturists buy farmland. According to a guide by the law firm K&S Law, Tamil Nadu has no restriction on buying or selling agricultural land. The limit it does impose is on how much land you can hold, under the Tamil Nadu Land Reforms (Fixation of Ceiling on Land) Act, 1961.

The land portal 1acre.in puts it the same way: any Indian citizen can buy agricultural, horticultural, residential, commercial or industrial land in Tamil Nadu, subject to the ceiling caps and registration rules.

Rules change and individual cases differ, so have a property lawyer confirm your eligibility before you pay an advance.

How much agricultural land can you hold?

The ceiling is measured in standard acres, not ordinary acres (see below). The limits, as summarised by K&S Law:

Who holds the landCeiling
A person, or a family of up to 5 members15 standard acres (it was 30 before the 1970 amendment)
Each family member beyond 55 more standard acres, up to 30 standard acres in total
Stridhana land held by a female family memberUp to 10 more standard acres
Companies engaged in industrial or commercial undertakings15 standard acres
Charitable trusts5 standard acres
Religious trustsNo limit
Hospitals and educational institutionsAs their norms permit

For the ceiling, a family means you, your spouse, your minor sons and unmarried daughters, and minor grandchildren in the male line whose father or mother has died. Land held by all of them is counted together.

K&S Law also notes that a 2008 amendment lets a person hold land beyond the ceiling with the government's permission. Land held above the ceiling without such permission can be declared surplus, taken over by the state and redistributed (1acre.in).

What is a standard acre?

A standard acre is a unit that adjusts for the quality of the land. Wet (irrigated) land counts for more than dry land, so one standard acre of dry land covers more physical area than one standard acre of wet land. The conversion depends on the land's class and is set out in Schedule I of the Act.

In practice, this means the same 15 standard acre limit can allow a larger physical extent of dry land than of wet land. Your patta and the land's classification (nanjai/wet or punjai/dry) decide how it is counted. You can check patta and land records on the Tamil Nadu e-Services portal.

For most buyers of a few acres or a managed farmland plot near Chennai, the ceiling is far away. It matters if your family already owns farmland elsewhere in the state, because all of it is counted together.

Can NRIs or OCI cardholders buy agricultural land?

No. This is set by central foreign exchange rules, not by Tamil Nadu. The RBI's Master Direction on immovable property says an NRI or OCI can buy any immovable property in India other than agricultural land, plantation property or a farm house. They also cannot receive these as a gift.

  • Inheritance is allowed. An NRI or OCI can inherit agricultural land from a person resident in India (RBI Master Direction).
  • Land bought while resident can be kept. RBI's FAQ says a person who bought agricultural land as a resident can continue to hold it after becoming an NRI, without RBI approval.
  • Selling: an NRI or OCI who holds agricultural land can sell it only to a person resident in India (RBI FAQ).
  • Residential and commercial property is different. NRIs and OCIs can buy flats, villas, approved residential plots and commercial property.

If you are an NRI looking at a "farmland" project, ask the developer exactly what you are buying. If the land is classified as agricultural, an NRI cannot buy it.

Checks before buying agricultural land

  • Confirm the land is agricultural and check its wet or dry classification on the patta and Adangal or A-register.
  • Match the seller's name on the patta, chitta and sale deeds, and get an encumbrance certificate (EC) for at least 30 years. See our land documents checklist.
  • Add up your family's existing holdings if you already own farmland, and check them against the ceiling.
  • If you plan to build or subdivide later, check what approvals that needs. Our CMDA vs DTCP guide explains layout approvals.
  • For managed farmland, read what the agreement covers: who farms the land, who pays for maintenance, and whose name is on the patta. See our managed farmland guide.
  • Have a property lawyer review the title before you pay an advance.
